Trade Mark Protection
You want to protect a new trade mark. Which can be a plant name, a company name or emblem.
Trade mark protection is technically possible in three ways:

1.Word mark, the name is being protected.
2.Emblem, the complete design is being protected.
3.Form mark, the complete design is being protected, including the (three dimensional) form.

Word Mark
At the protection according to the word mark of a trade mark some marginal comments must be made. First: the mark could be a so-called "weak mark". That means that it is practically impossible to protect offen used words by word mark protection. Second: it is possible that the owner of another trade mark that uses one of the words protected by you, thinks that confusion can arise by the use of the new trade mark. This owner shall prohibit the use of your trade mark. Subsequently, the fact that in many trade marks already often reocurring words are used, it is logical to expect that many of such words will follow. And then your chickens will come home to roost!

Emblem
In many cases it is more sensible to protect an emblem. That is the complete design of the trade mark. The whole concept will also be registered.

Form mark
If a trade mark consist of a three-dimensional form you can protect it as a form mark.

Classes
Protection of trade marks always takes place in a number of classes of service and products which are previously defined. Before you decide to register a trade mark you have to determine in which classes you protect your trade mark.
