Trade Mark Right
The Trade Mark Right legally falls under intellectual properties. That means you can be the owner of a new trade mark (i.e. to an invention that falls under the patent law.) Nobody is allowed to use the trade mark without permission of the owner.

Protection
Protection of a trade mark will be started by applying trade mark protection for the Benenlux.

It's not possible to apply for worldwide protection by means of a single registration. According to the Agreement and Protocol of Madrid protection by means of a single registration can been arranged in approximantely 60 countries. In that case you have to pay extra for each country and above that, for countries as Scandinavia and the United Kingdom, also the indivdual right.

Procedure
You have to authorize New Variety to apply for a Benelux Trade Mark Protection. Trade Mark Protection. Trade Mark Protection consist of two parts, the investigation and the depositary part. Outside the Benelux, this is always done per country. Condition is that the trade mark is already protected in the Benelux.
